Dear Sri Roop Chand,

                        This is regarding the minutes of the meeting dated 03-11-2011 regarding cadre restructuring of IPOs/ ASPOs published on the blog. I hope that these discussions were held purely on the basis of cadre restructuring of IPOs/ASPOs as per the committee formed for the purpose.  I hope that you will appreciate the concern of all the members and in particular the IPOs eagerly waited for a very long time for the verdict of Hon CAT Ernakulam which was finally delivered in our favour. Now, based on the discussions held during the last meeting, it is presumed that, the department is beating the bush and thereby again delaying the much awaited upgradation of grade pay to IPOs. I hope you will appreciate a suggestion that we have to persuade the Finance Secretary and our Secretary regarding the upgradation of grade pay of IPOs and thereby implementation of CAT order. I would like to mention here that the Hon CAT verdict discussed in length the parity existed and the clear recommendation of sixth pay commission and finally come to the conclusion that the Ministry of Finance shall have a re-look in the matter at the level of Secretary and consider the case of the Inspector (Posts) for upgradation of their grade pay at par with that of the Inspector of income tax, of CBDT and CBEC.

The Inspectors of Income tax , CBDT , etc got their upgradation in April 2004 and the IPOs in Karnataka fought the case in 2005 at Hon CAT Bangalore which disposed the case by directing the applicants to approach the Pay Commission as this was fit case for recommendation. The Pay commission has done justice to IPOs in the report and we were deprived off again.


Now, after 7 long years IPOs are brought on par with their counter part of Inspectors in other Central Govt. depts. Therefore I request you to persuade our Secretary and Finance Secretary to implement the CAT order to the extent of upgradation of Grade pay of IPOs to Rs 4600 wef 01-01-2006. After implementation of CAT, Ernakulam orders majority of the ASPOs will be in Rs 4800/-(I MACP to Direct recruitees, II MACP to promotees) or Rs 5400/- (II MACP to Direct recruitees, III MACP to Promotees) grade pay and upgradation of posts to PS Broup B has no impact in their career except the All India transfer liability. The restructuring is in the departmental interest of utilizing the ASPOs in higher grade pay as PS Group B than the ASPOs concerned.
Hence the issues relating cadre restructuring / forgoing Gazetted status by ASPOs/ creations of more No of Gr B posts etc should not be linked to CAT order because the Hon CAT confined its final para regarding upgradation of  grade pay of IPOs at par with that of Inspector of Income Tax ,CBDT etc.
I hope that you take forward this suggestion for an early settlement of the grave issue pending for long time.

    Thanks for again highlighting the issue. I had also expressed the view that the upgradation of Grade pay of Inspector Posts and other issues such as merger or cadre restructuring issues should not be linked. We are waiting for pay parity with our counterparts in CBDT/CBEC & Assistants in CSS since 2004. Now, time has come to put our maximum efforts to get the parity. As far as hierarchy issue is concerned, the respondents (i.e MOF & DOP) had raised this issue before the Hon'ble CAT also. Even after considering the hierarchy problem, the Hon'ble CAT has established that there is no justification for denying the Inspector Posts the higher Grade Pay of Rs 4600 when the same is admissible to Inspectors of other Departments with whom parity has been established by the very Sixth Pay Commission.
    We may put maximum efforts to get grade pay of Rs.4600 w.e.f 01.01.2006 and after that we may fight for other issues.

  4. Yesterday I spoke to Mr.Permanand and Sri Dineshkhare in this connection. Since Mr permanand will followup the matter with finance department today [ 21.11.2011 ], we [ from union side] may give written consent letter to Dte stating that Hon.'CAT' orders to be implemented soon and cadre review opinion will be given from union side separately after discussing pros and cons. This two issues are different and it should not linked up.
